4. Engagement and Payment Terms

- We retain the right to use general knowledge, skills, and techniques gained through the engagement
7. Confidentiality
Both parties agree to maintain confidentiality of sensitive information:
- Confidential information received during the engagement shall not be disclosed to third parties without consent
- This obligation survives termination of the engagement
- Exceptions include information required by law or to enforce legal rights
8. Limitation of Liability
To the extent permitted by law:
- Our liability is limited to the fees paid for the specific service in question
- We are not liable for indirect, consequential, or incidental losses
- We exclude all implied warranties and conditions
- Our total liability for any claim is capped at the fees paid in the 12 months preceding the claim
- This limitation does not apply to liability for death or personal injury, fraud, or breach of statutory obligations
9. Termination
Either party may terminate an engagement as follows:
- Either party may terminate with 14 days written notice
- Payment is due for all services delivered up to the termination date
- Either party may terminate immediately for material breach
- We may terminate if payment is not received within 30 days of invoice
10. Governing Law
These Terms are governed by the laws of Western Australia, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
11. Australian Consumer Law
Our services are supplied in accordance with the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL). Where any consumer guarantees apply, our liability is as prescribed by the ACL.
12. Dispute Resolution
In the event of a dispute:
- Parties will first attempt to resolve the dispute through direct negotiation
- If unresolved within 30 days, parties agree to engage in mediation
- If mediation is unsuccessful, either party may proceed to litigation

We may update these Terms from time to time. Updated Terms will be posted on this page with an updated "Last Updated" date. Continued use of our services constitutes acceptance of any updated Terms.
